Committee approves Hornberger’s plan to protect privacy during divorce filings

The House Judiciary Committee has approved state Rep. Pamela Hornberger’s plan to protect the privacy of individuals involved in a divorce filing.

Current court rules allow for divorce filings to be made public days, and sometimes weeks, before the defendant even knows that it has been filed. Hornberger’s plan would change that practice by amending Michigan Court Rules to ensure divorce filings are not made public before the defendant has received notice of the divorce complaint and that proof of that notice is filed with the court.

“The ending of a marriage is a very personal issue involving a great deal of emotional turmoil,” said Hornberger, of Chesterfield Township. “No one should ever find out about their own divorce second-hand. It’s common sense and decency that we ensure they be the first to know about the filing of their own divorce.”

Hornberger’s plan now moves to the House floor for further consideration.
